“Exceeded Authority”: Court Strikes Down Trump’s Global Tariff Regime

A U.S. appeals court has formally ruled that President Donald Trump “exceeded the authority” granted to him by Congress when he imposed a global tariff regime using a national emergency law. The decision is a direct repudiation of his administration’s legal interpretation and a major victory for his opponents.
The court’s 7-4 decision dissected the International Emergency Economic Powers Act (IEEPA), concluding it was never intended to be a mechanism for setting broad import duties. The ruling affirmed a lower court’s finding that Trump’s actions went beyond the powers delegated to the executive branch, effectively legislating from the White House.
The verdict has significant international repercussions. Trade agreements forged under the threat of these now-illegal tariffs are suddenly vulnerable. Trading partners may now argue that they were coerced into deals based on an unlawful act, creating a new wave of global trade disputes.
With an appeal to the Supreme Court certain, the tariffs will likely remain in effect for the time being.
